Terms of Service & Intermediary Compliance

1. Intermediary Status & Statutory Notice (IT Act Section 79 & IT Rules 2021)

PRIV SPACA operates as a communication intermediary under Section 79 of the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. By creating an account, you agree to comply with these Terms and our Community Guidelines.

2. Rule 3(1)(b) Strictly Prohibited Content

Under Rule 3(1)(b) of the IT Rules, 2021, you shall NOT host, display, upload, modify, publish, transmit, store, update, or share any information that:

1. Belongs to another person and to which you do not have any right;
2. Is obscene, pornographic, invasive of another's privacy (including Non-Consensual Intimate Imagery / NCII or morphing), insulting or harassing on the basis of gender, racially or ethnically objectionable, or encourages money laundering;
3. Is harmful to children or constitutes Child Sexual Abuse Material (CSAM) (zero-tolerance immediate permanent ban and mandatory reporting to authorities under the POCSO Act);
4. Infringes any patent, trademark, copyright, or other proprietary rights;
5. Deceives or misleads the addressee about the origin of the message, or knowingly communicates misinformation, patently false information, or non-consensual deepfake impersonation;
6. Impersonates another person;
7. Threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign States, or public order;
8. Contains software viruses, malware, phishing links, or computer code designed to interrupt or destroy any computer resource.

3. Eligibility, Account Termination & Governing Law

• Minimum Age: You must be at least 18 years old (or 13+ with verifiable parental consent under Section 9 of the DPDP Act, 2023) to use PRIV SPACA.
• Enforcement: Accounts violating Rule 3(1)(b) are subject to immediate suspension or permanent removal.
• Governing Law: Governed by the laws of the Republic of India, with exclusive jurisdiction in the courts of Jaipur, Rajasthan, India.
